SCI FI Channel SCI FI + 2 Competition Terms and Conditions PARTICIPATION 1. This competition (“Competition”) is conducted by TV1 General Entertainment Partnership, (ABN 19 094 282 021) of Building 208, Lang Road, The Entertainment Quarter, Moore Park, NSW 2021 (“Promoter”). 2. Entry to the Competition constitutes acceptance of these conditions. All entry instructions and prize information published by the Promoter form part of these conditions. 3. The competition is only open to “Eligible Entrants” being individuals who (i) are residents of Australia, (ii) are aged 15 years and over, (iii) are not employees of the Promoter or any of its related corporations or any of their agencies associated with the Competition; and (iv) are not a spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of such an employee. 4. The competition commences at 12:01am (AEDST) on Friday 13 November 2009 and concludes at 11:59pm (AEDST) on Sunday 13 December 2009 (“Entry period”). ENTRY TO COMPETITION 5. To enter online, participants must: a. Log onto www.scifitv.com.au and click through to the competition registration page and enter their contact details including (but not limited to) first name, last name, address, phone number and e-mail address and submit the fully completed entry form. 6. Once an online entry is submitted, entrants will be given the opportunity to refer friends to the competition. Entrants must have an existing relationship with the referred person. For every referred friend that subsequently enters the competition in accordance with the directions, the original Eligible Entrant will receive an additional entry into the Competition. 7. To refer a friend, Eligible Entrants must, once their entry is complete, follow the instructions to the dedicated page and provide the requested details including their friend’s unique valid email address. Each referred friend will then receive a promotional email that has been authorised by the Eligible Entrant to be sent to their referred friend, inviting them to enter. For ever referred friend that enters the competition via clicking the link in the promotional email and entering the requested details, the initial Eligible Entrant will receive additional entries in accordance with these Terms and Conditions. Eligible Entrants warrant that the friend that they intend to refer the competition to is an Australian residents aged 15 years and over and would normally consent to receiving such emails from the Eligible Entrant. Eligible Entrants may only refer the competition to a friend’s unique email address once. 8. Existing members who have opted in to receive mobile communications will receive an MMS message offering them a bonus entry by: a. Logging onto the mobile site http://mobile.scifitv.com.au and entering their contact details including (but not limited to) first name, last name, address, phone number and e-mail address. (Note: Mobile internet access is required and data charges may apply). 9. By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages. If entrants do not consent to their details being used for future marketing purposes, the entrant should contact the Promoter on their details set out below. Any request to update, modify or delete the entrant’s details should be directed to the Promoter. 10. Any costs associated with accessing the Competition website are the responsibility of the Eligible Entrant and are dependent on the internet service provider used. 11. Only one entry per person will be accepted (with the exception of a bonus entry either by referring friends or by entering via the mobile site). 12. Incomplete and incomprehensible entries will be deemed invalid. 13. Only one prize per person will be awarded (SA residents are entitled to win more than one prize). 14. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and proof of entry validity order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered. 15. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause. DRAW AND PRIZES 1. PRIZES: There are 28 prizes available to entrants. 1st prize: 2 x iPhone 3GS 32GB valued at $1,040.00 each (Total value = $2,080) 2nd prize: 2 x iPod Nano 16GB valued at $249 each and 2 x $50 iTunes vouchers (Total value = $598) 3rd prize: 2 x DVD Packs consisting of Heroes (Seasons 1 – 3) and Battlestar Galactica (Seasons 1 – 4) valued at $669.40. 10 x Runner-up Prizes: Ten winners will win: a SCI FI prize pack containing 2 bags, 2 caps, 2 water bottles, 2 t-shirts and 2 pairs of slippers valued at $40 per pack (Total value = $800). 2. Total prize pool is valued up to = $4,147.40 (including GST) 3. All prize values are correct as at 4 November 2009. The Promoter takes no responsibility for any variations in prize values. 4. Prizes are not transferable and cannot be redeemed for cash. 5. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation. 6. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit. 7. By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize. 8. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize. 9. Each valid entrant who has entered the competition over the duration of the promotional period will be entered into the draw. 13 valid entrants will be drawn at random to become the Prize winners. The draw will take place at Beinteractive Pty Ltd, Level 9, 155 George Street, Sydney NSW 2000, on Tuesday 15 December 2009 at 11am (AEST). WINNERS 10. Winners will be notified by telephone within 2 days of the draw and will also be sent a letter advising them of their prize. Winners of prizes valued over $250 will be published in the Public Notices section of The Australian newspaper on Tuesday 22 December 2009 and on the SCI FI website at www.scifitv.com.au. 11. Subject to State Regulation, an unclaimed prize draw will take place at Beinteractive Pty Ltd, Level 9, 155 George Street, Sydney NSW 2000 on Monday 15 March 2010 at 11:00am (AEDST) and any winners will have their details published in the Public Notices section of the Australian on Monday 22 March 2010. 12. Prizes will only be awarded to the entrant whose name appears in the entry. 13. Should an entrant’s contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter. 14. The promoter’s decision is final and the promoter will not enter into correspondence regarding the Competition result. 15. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements. 16. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion. GENERAL 17. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation. 18. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prizes except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries. 19. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. 20. TV1, Beinteractive Pty Ltd and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available. 21. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given under State Regulation. 22. All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion but no further use of this information will be made without prior consent. Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation.
